Terms of Service
Last updated: 1 September 2026
These Terms of Service (“Terms”) govern your access to and use of Truckonnect’s website and platform (the “Service”), which connects shippers who need to move goods (“Shippers”) with truck owners and operators who have available capacity (“Transporters”). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Who we are
Truckonnect operates a digital freight marketplace for East Africa. Truckonnect is a marketplace and booking platform: we are not a carrier, and we do not own, operate, or control any truck listed on the Service. Transport services are provided directly by independent Transporters, who are solely responsible for the safe, lawful, and timely carriage of goods they accept to transport.
2. Eligibility and accounts
- You must be at least 18 years old and able to form a binding contract to use the Service.
- You must provide accurate, current information when creating an account and keep it up to date.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- The Service supports three account types — Shipper, Transporter, and platform Administrator — each with different capabilities. You must only use the account type that matches your actual role.
- We may suspend or terminate an account that provides false information, violates these Terms, or is used fraudulently or unlawfully.
3. Bookings, escrow, and commission
- A Shipper requests a truck for a specific route, cargo, and pickup date. Pricing shown to the Shipper is the fare set by the Transporter for that route (or its default route), plus any commission and fees disclosed at checkout.
- When a Shipper pays for a booking, funds are held in escrow by Truckonnect rather than paid directly to the Transporter.
- A booking must be accepted by the Transporter and, where applicable, approved by a Truckonnect administrator before it is confirmed. A Transporter or administrator may decline a booking, in which case the held funds are released back to the Shipper.
- On successful delivery, the held funds are released: the Transporter receives the trip value less Truckonnect's platform commission (currently 10% of trip value, which may change with notice), and Truckonnect retains the commission as payment for operating the marketplace and escrow service.
- Payment processing is carried out by third-party, licensed payment partners. You may be asked to agree to their terms as part of completing a payment.
- Pricing for a route is set by the Transporter as a base fare for that route; any rate-per-kilometre figure shown is informational only and is not separately charged.
4. Transporter obligations
- You confirm that you own or are authorised to offer the truck(s) you list, and that all information about the truck (type, capacity, route, pricing, and availability) is accurate.
- You are responsible for ensuring your vehicle is roadworthy, appropriately licensed and insured, and that your drivers hold valid licences, for every trip you accept.
- You agree to provide the verification documents requested by the Service (such as logbook, insurance, driving licence, national ID, and any applicable transit documentation) truthfully and to keep them current. Listings may be marked unverified or may be revoked if documentation is missing, expired, or found to be false.
- You are responsible for the safe and timely collection, transport, and delivery of goods for any booking you accept, and for complying with all applicable transport, customs, and safety laws.
- You may mark your truck unavailable, or block out dates, at any time; accepted bookings must still be honoured or properly cancelled through the Service.
5. Shipper obligations
- You confirm that the information you provide about a shipment (pickup and drop-off locations, cargo description, and weight) is accurate.
- You agree not to book transport for any goods that are illegal, hazardous without proper disclosure and handling, or otherwise prohibited under applicable law.
- You are responsible for ensuring goods are properly packaged and ready for collection at the agreed time and location.
- You agree to pay the fare and any applicable fees shown at checkout for a booking you confirm.
6. Prohibited use
You agree not to: use the Service for any unlawful purpose; circumvent the Service to transact with a Shipper or Transporter you met on the platform in order to avoid fees; misrepresent your identity, vehicle, or cargo; interfere with or disrupt the Service’s operation or security (including attempting to bypass rate limiting or authentication); or use the Service to transport goods prohibited by the laws of Kenya or any relevant jurisdiction along the route.
7. Cancellations, refunds, and disputes
- A booking may be cancelled before acceptance by either party, or declined by the Transporter or an administrator, in which case escrowed funds are released back to the Shipper.
- If a dispute arises about a booking (for example, non-delivery, damage, or a pricing disagreement), either party may flag the issue for review. Truckonnect administrators may investigate flagged bookings and make a determination, including adjusting the release of escrowed funds, acting reasonably and in line with the information available.
- Truckonnect's role in dispute resolution is to help facilitate a fair outcome between Shippers and Transporters; it does not guarantee a particular outcome and is not itself liable for the underlying transport dispute, except as set out in Section 8.
8. Disclaimers and limitation of liability
The Service is provided on an “as is” and “as available” basis. Truckonnect is a marketplace connecting Shippers and Transporters and does not itself transport goods. To the maximum extent permitted by law, Truckonnect is not liable for the acts, omissions, delays, damage, or loss caused by any Transporter or Shipper, or for indirect, incidental, or consequential damages arising from use of the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the laws of Kenya, including in respect of fraud or wilful misconduct.
9. Indemnification
You agree to indemnify and hold Truckonnect harmless from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your use of the Service, or your violation of any law or the rights of a third party.
10. Suspension and termination
We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or unlawful activity, or posed a risk to other users or to the Service. You may stop using the Service and request deletion of your account at any time, subject to the completion of any pending bookings and applicable record-keeping obligations.
11. Intellectual property
The Service, including its design, branding, and underlying software, is owned by Truckonnect or its licensors and is protected by applicable intellectual-property laws. You may not copy, modify, or create derivative works of the Service except as necessary to use it as intended.
12. Changes to these terms
We may update these Terms from time to time. We will update the “Last updated” date above when we do, and where changes are material we will provide additional notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of Kenya, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of Kenya.
